These terms govern your use of Qcom, our multi-channel communication platform. By using our services, you agree to these terms.

Agreement to Terms

By accessing or using Qcom (“the Platform”), you agree to be bound by these Terms of Service. If you are using the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

If you do not agree with any part of these terms, you must not access or use the Platform.

Description of Services

Qcom is a multi-channel communication platform that enables businesses to manage customer messaging across SMS, Email, and WhatsApp from a single workspace. Our services include:

  • Multi-channel messaging — send and receive SMS, email, and WhatsApp messages
  • Contact management — organise and segment your audiences
  • Campaign tools — create and schedule bulk messaging campaigns
  • Workflow automation — trigger messages based on events and schedules
  • Analytics — track delivery, engagement, and campaign performance

Account Registration

To use Qcom, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Each workspace operates as a separate tenant. The account owner is responsible for managing team member access and permissions within their workspace.

Messaging & Communication

When sending messages through Qcom, you agree to comply with all applicable laws and regulations, including anti-spam legislation such as CAN-SPAM, GDPR, and POPIA.

You must ensure that:

  • All message recipients have provided appropriate consent to receive communications
  • Messages include a clear mechanism for recipients to opt out
  • Sender information is accurate and not misleading
  • Message content does not contain prohibited or illegal material

We reserve the right to suspend messaging capabilities if we detect abuse or non-compliance.

Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable law or regulation
  • Send spam, unsolicited messages, or phishing communications
  • Transmit malicious code, viruses, or harmful software
  • Attempt to gain unauthorised access to any part of the Platform or its infrastructure
  • Interfere with or disrupt the availability of the service
  • Scrape, harvest, or collect data from the Platform without authorisation
  • Impersonate another person or entity

Data & Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. For how we secure the service, see our Security overview.

You retain ownership of all data you upload to Qcom, including contact lists, message content, and campaign materials. We do not sell your data to third parties.

You are responsible for ensuring that your collection and use of personal data through the Platform complies with applicable data protection laws in your jurisdiction.

Payment & Billing

Certain features of Qcom require a paid subscription. By subscribing, you agree to pay all fees associated with your selected plan. Fees are billed in advance on a monthly or annual basis.

Messaging costs (SMS, WhatsApp) may be charged on a per-message or per-conversation basis depending on your plan and the channel used. Usage-based charges are billed at the end of each billing cycle.

All fees are non-refundable except where required by law. We may change pricing with 30 days' written notice.

Intellectual Property

The Platform, including its design, code, features, and branding, is owned by Qymmo and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Platform without our written permission.

Content you create and send through Qcom remains your intellectual property.

Termination

You may close your account at any time by contacting support. We may suspend or terminate your access if you breach these terms, engage in prohibited activity, or fail to pay applicable fees.

Upon termination, your right to use the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, Qymmo and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of revenue, data, or business opportunities.

Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

Changes to Terms

We may update these terms from time to time. When we make material changes, we will notify you via email or through a notice on the Platform at least 30 days before the changes take effect.

Your continued use of Qcom after the updated terms take effect constitutes your acceptance of the changes.
